You: i purchased two boosts the other night and then used them for 1 hour then yesterday your servers were down all day so i only got 2 hour use of them

Wow, just wow. I honestly don't see how they can't offer you a refund or another boost to compensate.

If you are feeling really torqued about this you could always sue in small claims court for the typical $5000 for breach of contract. You paid for 12hrs? of boosts and only received 2 hrs because of incompetence of the company. You'd force them to have to pay a lawyer to show up or you'd win a default judgment.

This game is going to fail quickly if they continue to treat customers like this. I'd also complain to Microsoft that basically this game ripped you off of your MS points.

Re read your ToS agreement.

No contract (ToS) can rob you of basic rights nor entitle an entity to commit fraud. You can put whatever you want in a contract/ToS but in the end it'll have to stand up in a court if it goes that far.

So basically what you're saying is, if someone opts to buy boosts in the Defiance store and then those particular boosts aren't fulfilled due to server down time, then they should 'sue'?... yeah, good luck with that logic.

You do have a recourse when a company fails to honor an agreement/contract.

So can you please point out where it says

- If a user purchases in game material, whether it be Bonuses / Bits / Boosts for real money and then the servers are taken down for maintenance. They are offered a full refund due to loss of time as compensation.

- If compensation cannot be offered then users are advised to take the situation to a small claims court, pay out of there own pocket just to be even seen by a judge let alone court costs.

Seriously, you might think Trion is a small time company but I'm pretty sure they have everything covered when it comes to legal actions like this. Small prints / Loop Holes and everything else will be thought of.

I too make dramatic threats towards the GMs when they don't give me what I want on Live Support. Even called the last guy a "kitchen sink". Yeah, I went there.

I wonder though... can they "hang up" on you in chat support? I've personally never tried it and have always left first, but I wonder if they have to stay there and deal with you for as long as you want. Turning it into a "lets see who rust first" type of scenario.

Good question, however, their rules could also be the same as those 'Cold Callers' or 'Tele Sales' people in which they aren't allowed to hang up until the person they're ringing ends the call.

That's there weakness.

So for example, they could ring you up hoping to pitch their companies product to you but they don't expect you to explain why your nans bowel movements are irregular and looks like rusty water. It's their job lol

This is one of the reasons that I won't be buying anything that's time sensitive like boosts. I just don't trust Trion to keep their servers up during the timeframe of the boost.

This is incredible. I tried three times yesterday to live chat but they kept ending it before I got with a rep. Some ********. I don't want a refund. I just want a few hours of time they wasted back from boosts. I will buy nothing more from these crooks. Just because a lawyer rights it up doesn't make it legal or right. I'm not threating suit because its not worth the time or energy. But someone will. Bigger fish, as Trion has failed to deliver on their product. Sponsors will pull out. If it all came to that, a class action or something, they'd file bankruptcy and those part of the suit (if gamers) would be lucky to see 3 bucks out of their 60 spent on game only. Nothing on digital ****. But there is nothing we can do but stop buying anything else till they address our collective unhappiness. Don't hold your breath, though. They will communicate zilch to us, their supporters.

This is all doomed. Game, show, etc. Sucks because its all a good idea. Like the show, as generic as it is. Too bad we have no rights after having already put into it. At this point alll we can do is walk away. Won't work either. Not enough would do it. This will be remembered as a farce. A joke. A disaster in the end. I have put more money than most into this because I believed in the idea. We all did, in our own capacity.

We deserve to have our grievances addressed by Trion. They owe us that, if anything. No handouts, no refunds perhaps, but to have our questions and concerns answered.

You think thats bad. Ive had weapons go missing numerous times. Ive had boosts wasted just like this guy the other day. Trion do nothing.

I will keep playing because i like it and have time invested into it. But i will NEVER buy another Trion game again.

The ToS doesn't cover bits, those are not "virtual", they are a direct representation of currency(just like MS points). Now things purchased like boosts, those have a 24 hour advertisement. We are protected by the Federal Trade Commission Act, and since Trion Worlds is in CA, they also fall under the UCL. If you you earned boosts in the game without the use of money, then they would be able to say "no we won't refund or compensate you". Now purchasing boosts right before a patch or on patch day, well that's just silly, so just say no. Throwing around the threats of lawsuits just makes one sound uneducated, instead file a complaint with the FTC. They would be better equipped to answer your questions, and be far better to listen to than a bunch of gamers who think they know law, I know I'm no expert.

Edit: Paying for a service and receiving something other than advertised and using the "ToS" or any other reasoning would be in direct violation of both FTC and State laws(California).

Dealt with the same problem and was told the same thing. Was also told that the "higher ups" know about the situation and are trying to find ways of fixing it.

While they covered their butts in the ToS very well, I'd say it still is pretty lousy customer service. In their position, I would've just renewed the boost time in lieu of a refund.

I had my Live account hacked not too long ago and the perp used the 1600 ms points I had just put in the night before release of some Skyrim DLC to download Minecraft. After about 30 minutes, Microsoft refunded the spent points by giving me a new code, and they allowed me to keep the full version of Minecraft, a $20 game. They didn't have to do that, but they did, and because of that I'll be a loyal customer for as long as I can see.

Trion, in my opinion, should have at least renewed the boost time, or go the extra mile and double it.

I sent in a in game ticket and was refunded my bits, then was told that the problem was known and if I was to spend more bits on boosts that I might not get any more refunds on them.

i got the reponse in like 2 hours.

A good point sir, I don't understand why Trion would not simply cut this guy a break, it cost them nothing and makes the customer happy and loyal. Their Sales Service Mgmt and team need some serious coaching.

Yes the Trion ToU (http://trionworlds.com/en/legal/terms-of-use/) does say no refunds on virtual purchases, but being nice, calm, and persistent can often yield a positive result. Try contacting Trion's Support on a different day, and very nicely explain how disappointed you were the servers were down, and how much you missed playing the game, and you are not looking for a refund; you simply need this awesome tech support staffer's help to reset your Boost timer, and how happy and grateful you would be for their help.

If that does not work and you really want to pursue the matter there are lots of ways you can try and motivate Trion Worlds to do the right then and honor their obligations to you w/o suing. In addition to complaining to the FTC, and the CA Attorney General's Office you can also try:

File a complaint with the Redwood Better Business Bureau (http://www.bbb.org/greater-san-francisco/business-reviews/general-merchandise-retail/trion-worlds-in-redwood-city-ca-373637/complaints).
The Redwood, Chamber of Commerce (http://www.chamberofcommerce.com/redwood-city-ca/36737556-trion-world-network-inc/).
You can take your story to The Consumerist.com, (http://www.consumerist.com/) same folks who gave Electronic Arts the worst company in the world award to years running, they LOVE to post this kind of thing.
