It likely isn't grave concerns, it's lawyers and accountants and marketing strategists. The probably have it in their contracts somewhere, a clause dealing directly with beta software, and their policies. They're Microsoft, they don't have to bend over backwards for Trion - who is fulfilling their contractual obligations with both Microsoft and their customers.
You're right, they did say not entirely, perhaps M$ wants compensation for allowing beta software to be run, as in, leasing specific servers and bandwidth to handle it at an extremely high cost. Losing a few preorders, compared to 100k to lease the servers would seem acceptable losses, IF it were the case, which I can't say if it is.
