I don't know about the first part, but Trion has said yes about the second. Your character data is stored on their servers and if it had to be converted in some way, then they could do that. Regardless, they said it would be possible. As to the game being released on next gen consoles, that will depend on a lot of things so it's wait and see.
The one thing that might put a crimp in transferring a 360 character to the One or PS3 to 4, is MS and Sony. Our characters, many of them have paid content attached to them, even if it was just boosts used to rank up, or inventory slots, or lock boxes. MS and Sony might object to that stuff being moved so people don't have to buy again. They might not but if they did, it would be pretty difficult for Trion to transfer the part of the character that has no paid for content attached to another console.
I mean, how do they remove the effect of boosts on your character and then inventory slots-do they dump items you have just to take away slots you bought? And do they take away weapons from lockboxes you purchased? As I said MS and Sony might not care but if they do then I think Trion would just say no to character transfers.
At a guess i'd say only if it was profitable for them.
I've submitted the very same question in their "ask a developer" thread the past few weeks. I already know that DCUO is making a jump to next gen hardware, so I figured this would be another no-brainer.
But DCUO isn't a game made by Trion... The only other game I've heard of going from PS3/Xbox 360 to the future platform thus far is Battlefield 4

We’re essentially just moving our client between consoles — it’s the same client.
Obviously, DCUO isn't made by Trion. But since it was announced that it was, in fact, making the jump to next-gen hardware, I wanted to know weeks ago if Defiance would also make the leap to next-gen hardware.
Who makes what game is pretty irrelevant, I just wanted to know if it would be ported to beefier hardware.
IMO Trion would be crazy to not port to next gen.
Not doing so would be like pulling the trigger on your big toe.
