The difference is that the vendor was not advertised to have better buy back rates than any other vendor in the game. That should have raised an automatic red flag, and at the very least players should have reported this and waited for official feedback to see if what was happening was intended or an exploit.
Quite frankly, if you get banned in a game, it is because you took advantage of a clear exploit that common sense would have told you was an exploit. People are not getting punished/banned because they sold a handful of items to the vendor. People are getting punished/banned because they saw how much the vendor was paying then specifically set out to get as much stuff as possible (several dozen handfuls worth, so to speak) to sell to that vendor to make a boat load of cash.
In my 30+ years of gaming I have never been banned nor punished in a game for taking advantage of an exploit. Why? Because I err on the side of caution and wait for official word on whether something is intended or an exploit.
