They have been very upfront about their efforts to work out any bugs, and improve the issues that need to be worked on, sounds pretty ethical to me. There are no features they advertised that are missing, and there is absolutely nothing to indicate any fraud.
There are bugs, some users are having issues, many are not. The fact that you claim to have some issues does not entitle you to a refund, nor does a lack of response from them indicate that they are refusing to deal with you. Submit a second ticket and see if they respond. They will likely say no. When they do, wait, and play on the 15th when most of the issues will have hopefully been resolved.
At this point, you still haven't really addressed what specific issues you've encountered, other than an alleged crash which isn't really indicative of anything on their end, and quite possibly a glitch on your system interacting with their client software.
