you weren't conned into a beta test, the software you received is a complete build. you received the software you paid for. it requires a constant server connection, which may not be available at all times, and they are not responsible for disruptions, because, stuff happens.

Can't sell/delete an item? Check all of your loadouts, it's likely still equipped.
Auction house? Why? It'll just render bits purchased lock boxes pointless, and weapons are mostly equal anyway.
Gear/enemy progression? No thanks, it'll only render 90% of the content trivial when you reach the highest zone.

First of all, people expecing a MMO to be flawless on release day is utterly ridiculous. You have absolutely no idea how much goes into making a video game let alone a MMO. It isn't about people who are complaining that is the issue but more so the people who are making DEMANDS. People who are going about this the wrong way. The developers can not and should not have to please every single person who plays they game because that is basically impossible. But they have been busting their butts since the game came out to fix everything they can and people just keep DEMANDING more. How bout you give THEM a break?

Well, they are right. Your refund will be received about the 2nd tuesday of next week. You WONT get it. No company anywhere makes refunds for computer software. Try and take a game back to Best Buy and get a refund, bet you dont. Maybe store credit, but your not getting your money back. Your hope lies in a class action lawsuit, which as ironhands has accurately pointed out, would be a thin argument at best. Could be made yes, but thin none the less. But as I also said, such lawsuits are not about reclamation of resources, its about punishment. (And for the other guy who actually sat down and read the agreements, court proceedings are public record. Making people aware of public record is not slander.) But for any amount of people you can line up that says they are having problems, an equal amount like me can be lined up saying we arnt. It would come down to your interpretation of events vs theirs, and the courts will ALWAYS side with the business in that situation.
And Dingo is right, a smart consumer researches their products before they buy them. You obviously did not. Im unhappy with the state of the game too, but you have to understand, there is nothing you can do about it. Either take it to gamestop for trade-in credit, or get over it. I have been playing MMOs for 18 years and in that time I have learned a lot about how compensation works when it comes to buggy software. Sure a refund for some people is the only way to make them happy however compensation is a completely different animal. For example in most MMOs if they have severe issues like Defiance is currently having they will give FREE items/gametime/or other COMPENSATION to make their customers happy.
It's a simple matter of keeping your consumer happy and if you don't keep them happy they will no longer purchase your product losing business down the line. At this point why would I or anyone for that matter purchase another Trion product? I played Rift and enjoyed it which is why I gave Defiance a chance. The game has been out over a week with months of beta testing and they can't resolve the crashing issues? I mean come on man there has to be some give and take.
So this "physical rut" you speak of is a bunch of moronic nonsense which does not make you look intelligent in the least. Times have changed but keeping consumers happy should still be the number one priority of any company trying to make a dollar.
