Are the Defiance television commercials false advertising?

The commercials on television show a polished, stable, smooth running, playable Xbox 360 game. Nothing like the game that I have purchased and been "attempting" to play, when it is playable. Is this false advertising? It sure feels like it at this point.

Because they used the PC version to use for in game moments since it can be the most stable with over 60 fps easily.
