Chat Restriction / Error?

Okay I keep getting this really odd error message when I boot up Defiance.

something about Audio chat being disabled due to my PS3's Account restrictions, I don't get the message everytime but I cant seem to get mike chat working at all.

sometimes I hear people chatting but its very low almost completely inaudible.

Just wondering if anyone has a clue. my headset is a Logitech USB headset and it has worked with other games before tho its been a while since I bothered hooking it up.
