Exactly, the wanna be lawyers here need to shut there mouth, and just leave the legal stuff to real lawyers. And if any of you think there gonna spend a dollar to get a nickle your crazy. Ya there gonna pay there hundred dollar and hour lawyer to try and get $60 dollars back, when the op has a good claim that he has a broken product, not worth there time or effort.

Hate to burst your bubble, but I work for a bank. There is a process involved here and you won't get your money back. They will investigate your alleged unauthorized use by examining the receipt files, once they determine that your signature is legit, they will close the chargeback with no return of funds as a false claim. "Unauthorized use" means someone used your card without your knowledge or permission, not "I'm not happy with what I bought". And yes, you have technically committed the federal offense of "Attempt to defraud" by lying to your bank and asking them to replace your money. Will they prosecute over a hundred bucks? No. But they could send you to prison if they we a-holes.

    You aren't too bright.

I just called the bank back to change my claim to "Charges for goods or services different from what was represented." Thanks for the tip guy who works at a bank.

It's called fineprint. The little hardly readable stuff that shows up hitting the confirmation button for buying it. Or for hard copies.......the small print on the back of the box. It's as viable as a contract. As long as the product doesn't stray outside of those usually vague conditions (that tend to favor the manufacturer) then it IS what you purchased.

Reporting it as not when it still meets the fine print is a fraudulent claim.

However if you were not the one who made the purchase (someone else did it in your name), then the company still wouldn't be liable as it would be criminal charges towards the unauthorized person who made the purchase in your name.

    Gotta love fine print.

I think pretty much all of you are making way too many assumptions on how the conversation between the original poster and his bank went, based on a very brief description of events he gave. Give the bank some credit and assume the conversation was longer than "there was an unauthorized use of my card".

So you called your bank and told them you commited fraud and want your reason changed?
    No sleep, no dreams.
    No pain, no joy.
In this state of unbeing I ask myself..
    Was I ever innocent?
