    and the best part is the gamers won't win because that's the nature of video games. Also the whole basis of the claim is pretty stupid, seeing as everyone knows game trailers can't be taken as 100 % gospel truth. It's been that way for years and years and years, it's unfortunate that stupid people will sue over this. It's akin to the women who sued McDonalds because their coffee was too hot and she burned herself, or the guy who slips on a floor during a rainy day.

    Are we really that stupid that we need disclaimers telling us the footage you see isn't assured to be the one you'll get in the trailer for a year before the game came out. Disclaimers telling us the coffee could be hot, or if it's raining outside you should probably be careful because the floor is probably slick?

    Also even if they win, the only person who wins will be the lawyers. Ultimately if the gamers who were truly screwed over by the trailers get anything, it'll be like a buck fifty.

    each of the points the guy were interview are in the game... except for the weather. they were vague on what 'MMO' was to them except play with thousands of players... the Vehicles can always be added since its still in the game. and i pre-ordered my game after participating in the first stress and watching the live streams videos on twitch.. i am disappointed in the lack of some MMO qualities in the game, but is still the same game that i saw in January.

    yep, the gamer sued because he claimed the trailers showed footage that wasn't possible in the game. The trailers that never claimed to be actual gameplay footage. You know what they say when you assume stuff right? Then they got the game and everyone was angry. Like I said, this case will be thrown out and from now on thanks to stupid people we'll have "This footage does not represent actual gameplay" added to every video, trailer we get from this point forward. I can't wait until the eventual person sues one of the major studios like Disney or paramount because the put deleted scenes in the movie trailer.

    I mean heck if you watch some trailers for boring movies they spice it up with loads of action scenes to make the movie look good, then you go see it and it's 2 hours of nothing but talking, come on man funk dat, lets sue.

    I'm pretty sure if you watched any Pauly Shore movies you could sue for emotional distress as well as false advertising. Except Encino man.

    I'm aware that Sega/Gearbox are not the first ones to do this. On a side note, anyone ever remember the previews for Highlander: Endgame in 2000? That was the Adrian Paul (Duncan MacLeod) feature film with Christopher Lambert (Conner MacLeod). They released a movie trailer that showed all sorts of things, ranging from a stargate type portal to the main villain having some sort of Quickening/magic ability like they used in a previous film.

    None of that was remotely within the movie. Turns out later that the trailer was filmed as a separate entity just to get the fans into the theater with fake scenes.

    The Motion Picture Association slammed into Dimension Films and Davis-Panzer Productions over that. Adrian Paul got a lot of fan ill-will toward him, too.

    So, it happens. I get that. I'm not saying to sue Trion or even remotely endorsing it. I was pointing out the stupidity of what one guy posted on how it would make it inhospitable to indie publsihers. No, it won't. If the lawsuit for A:CM wins, at its most basic it means common sense dictates to not advertise what you can't implement, or to put the "not actual gameplay footage" disclaimer in clear view.

    So, I'm not really sure of the point of what you were saying to me.

    Which makes Defiance advertisement videos and interviews even less credible, as it was not just some demo, or footages, but real presentations of actual features that were never implemented in the actual game in the 1st place.
