Which makes Defiance advertisement videos and interviews even less credible, as it was not just some demo, or footages, but real presentations of actual features that were never implemented in the actual game in the 1st place.

lol, like I said, please by all means go file a class action lawsuit, if you find a lawyer hack to actually take your case, please proceed to video tape the proceedings and post them on youtube. It'll be comedy gold watching you get owned. If you allow a lawsuit like this to proceed you open up the flood gates on other lawsuits. It's why i'm saying this one won't win.

A lot of things. EVERY MMO EVER has SOMEBODY trying to start a class action lawsuit because they are unhappy with the game. Nothing new here people, if you are seriously considering this, I just feel sorry for you.

this will happen more and more because someone got the sack to actually file a lawsuit, I have to give them credit for that at least.

This happens on every game, especially MMO's, yet somehow nobody ever manages to file one. Except this one dude for ACM lol

This lawsuit wont' be a victory, if anything it'll waste the courts time. To make a judgement against Gearbox, they'd open up the floodgates for this kind of class action lawsuit against any movie that puts deleted scenes in the trailer, against any game that provided a list of features and failed to deliver a few of those features, etc etc etc. Do you see why it will fail. I admire the fact that someone had the gaul to actually follow through with their threats of a class action lawsuit, but to think they can actually win it would be pretty far fetched.

I'm not too familiar with the Aliens game that gearbox made, but I've heard bad things about it. A bad game doesn't mean someone can sue and win for false advertising. For something like that, you'd have to have a product that was fundamentally flawed and continued to be sold as though it worked perfectly.

Not quite a guaranteed failure (though likely). The court does not have to rule in the entirety of the complaint, but can actually award a split ruling. What that means is: sections a, b, c are deemed invalid and tossed, or the developers found not liable; meanwhile sections d, and e stay and the plaintiffs could win on those.

The suit is dealing with sections of the Consumer Protection Laws, and isn't necessarily an all or nothing case. They rarely are. It's really going to depend on the judge and whether or not they even feel like dealing with it-- as yes, that also can get a case tossed quickly. Is it right that courts do that? No. But do they? Yes.

Even if it were to ever come to that. That case would be closed extremely fast. Since there is no proof that any of that stuff was going to be in the game Day 1 of launch. Hell they already talking about a crafting system POST LAUNCH. I guess that's false advertising as well.

The main point isn't for me to file a lawsuit.
But to get what we've paid for, and what was advertised in the 1st place.
When you show different aspects, systems and features to players, they need to be in game when purchased.
This goes for all the products we are buying, games included.
