With colonial marines, this is understandable. Prerelease footage (I believe there was some from e3 last year) showed a much more detailed game than what was released.

Also, please give me one instance where a feature that was advertised in gameplay footage or in its marketing(aside from the bikes many people are bound to say) did not make it to release

Consumer protection laws. I don't think any of those have been broken by Trion yet, though. But I'm not a lawyer.

Exactly. I'm far from a lawyer either, though I used to do a lot of case prep work as a Paralegal (read, research grunt) many years ago. We had a couple of Protection Law cases come through. As far as I can layman recall, I don't think developer diaries would necessarily be considered marketing under the Consumer Protection Laws. And as far as I can recall from their legal-definition marketing, Trion hasn't really misrepresented the game in a legal context yet.

And that. If the past 5 years of the MMO industry have proven anything at all, it's that not even big name titles like Star Wars: The Old Republic are exempt from market reactions to a shoddy game.

Defiance will hardly prove to be that exception if the Developers continue on their present course much longer.

yeah SW:TOR felt it sooner because they based all their profits off Subscriptions. but with Defiance, it may take longer for them to since its only buy to play. but they will if there's no one buying Season Passes or Bits

This is ridiculous. Trion could use their money to pay for much better things then having to pay a fortune in court fees. We're not talking about a juggernaut like EA with lots of resources and employees, it's a small company that's trying to do something great but has had a few crucial mistakes along the way.

Critical mistakes, arguably fatal mistakes. I want to root for the little guy just as much as you do, and I see absolutely no reason for legal action, but the little guy doesn't get a handicap for being the little guy. He's got to win it, just like the big boys.

Comparing an MMOTPS to a sp/mp game is asinine for one. A:CM deserves a CA suit which will fail ultimately though SEGA admitted they blatantly lied when they intentionally let a vertical slice look 100x better than the actual end product. It's ******baggery at it's finest. All MMOs have clauses in the fine print covering all aspects of MMO development.
