Critical mistakes, arguably fatal mistakes. I want to root for the little guy just as much as you do, and I see absolutely no reason for legal action, but the little guy doesn't get a handicap for being the little guy. He's got to win it, just like the big boys.

yes. Plus the little guy (Trion) is using big boy (SyFy/NBC) money to make the game. So Trion gets no handicap.

With colonial marines, this is understandable. Prerelease footage (I believe there was some from e3 last year) showed a much more detailed game than what was released.

Also, please give me one instance where a feature that was advertised in gameplay footage or in its marketing(aside from the bikes many people are bound to say) did not make it to release

There have been a lot of deceptive practices on Trion's part, but I don't think they've really gone as far to merit legal action yet (emphasis on the yet though because if they keep going down this river, they're going to stir up some people that will think that way).

Comments made on the forum that don't reflect the reality of the game. Dev blogs and advertisement that don't represent the game and hyping up the transmedia experience on the live streams and saying they don't want to disclose anything because of spoilers, they did this week after week and week after week we were like "wow, we're going to get something good" and when we finally get it, we want to slap a return to sender sticker on it.

The debacle with the patching and the nerfs... and the hacking...

I knew from the start that when they talked about how the game would shape the show that it was hogwash (at least for season 1) because season 1 was already filmed, but that would not stop them from changing the game based on the show, which to everyone's dismay, they have failed to deliver on their hype.

I want Trion to succeed like their previous title but they aren't giving me any reason to have faith at the moment.

BTW no matter what cry post you wrote here, game is sold very well and dont worry about SP many many many people will buy it.
BTW every day new players come to game and I often see players with EGO under 250. You know, TV show has success and many people want to try game becasue they like TV show. They will login every day for a few main missson / daily/weekly contracts and logout.
And again THIS IS NOT CLASSICAL MMO like WoW. This is mainly TPS iwth RPG elements and open world with other people/instances and Pvp maps. nothing more nothing less. its for people who want some fun gameplay and not HARDCORE no life MMO style.

and again.... devs can see, they know where are problems in this game and they make patches almost every week and your CRY/HATERS posts dont help. They have their money they can put shtako on you, becasue there are no monthly payments but as you can see, they dont do this and they still try to fix it. Take a break from game and try to wait for the next patch people. Nobody is curious about your CRies here.

Cool you posted the definition of what a class action lawsuit is, that's awesome and has zero baring on the ACM case nor on any potential lawsuit that Trion could face for this game. (I say could because every MMO known to man has faced threats of a class action law suit, and thus far none) Like I said already, the case against ACM will get tossed out, I'd assume all of it, seeing as you know, the whole basis is the original footage didn't match the finished product. Which is also the case whenever you watch a trailer for a movie and it has a deleted scene in it.

I guess you could say the original Psycho could have been sued for false advertising since the person they were hocking as the feature star of the movie died in 15 minutes. Nothing says I love video games like threatening to sue the developers and setting precidents that make the game market not even inhospitable but outright hostile to small or independent developers.

Small and independent developers do not advertise to the extent that Trion did. I remember the article talking about how things you do in the game affect what you see in the show and ditto for the other. They keep trying to put 1 (THATS RIGHT 1) pvp map in which seems was never tested. So please shush.
